Defendants, THE HON. DOUG BURGUM and THE HON. WAYNE STENEHJEM, in their official capacities as Governor and Attorney General of the State of North Dakota, respectively, and Defendant-Intervenor, NORTH DAKOTA IMPLEMENT DEALERS ASSOCIATION, hereby jointly provide this Notice of Appeal to the United States Court of Appeals for Eighth Circuit this Court’s Order, dated December 14, 2017, granting Plaintiffs a preliminary injunction preventing the enforcement of SB 2289 based on its apparent infringement 

upon the Federal Arbitration Act and the Contracts Clause of the U.S. Constitution. The Order at issue is attached hereto as Exhibit A.
